TRIALS AND SETTLEMENTS: Jury awards Fraud verdicts for $1,670,000 against Forbes 500, SEC regulated, Defense Contractor Textron |

In a landmark unanimous decision by the California Supreme Court, Partner Ralph B. Saltsman prevailed against the Department of Alcoholic Beverage Control. Saltsman and Solomon fought ABC prosecutors engaged in secret communications with the Director of ABC after disciplinary hearings. Such reports to the Director constituted “ex parte” communication prohibited by State Statute and the Constitution. The Courts now require disclosure and transparency, not secrecy. This decision and subsequent published Court of Appeal Decisions won by Saltsman will change the way state agencies do business. Indeed so far over 150 cases of SSJ clients were won as a result. |

Partner Stephen Jamieson recently completed the jury trial in Los Angeles Superior Court. Ryan Kroll assisted Mr. Jamieson during litigation and trial. Facts were proven that reflected this major corporation deceived our client. The court refused to grant Textron’s request to exclude lost profits and other types of monetary damages caused by the faulty product, even though the written warranty had language which, if applicable, would have limited these very real damages. Result: initial settlement offer by Textron of only $5,000 yet this Defendant ended up paying over $1,700,000. |

Solomon, Saltsman & Jamieson represents the San Pasqual Band of Mission Indians in a case with enormous implications to California’s Gaming tribes. Senior Partner and lead attorney, Stephen Warren Solomon, explains: “The State unfairly limits the number of slot machines these tribes are authorized to operate per compact. The State has wrongly convinced several federal district court judges that no tribe can go to court to enforce its own compact unless all 61 tribes join together in the same lawsuit.” Solomon says: “Indian tribes should have the same judicial remedies to enforce a contract as any other American. We look forward to the 9th Circuit Federal Court of Appeals ruling on this important issue.” |

LAND USE: Partner R. Bruce Evans represented the El Rodeo Nightclub in Pico Rivera, California which was allowed to keep its Conditional Use and Entertainment Permits after months of contentious hearings before the City’s Planning Commission and Permit Licensing Board. The El Rodeo Nightclub, a well known Los Angeles nightspot gained national attention after being featured in the feature film “Collateral” staring Tom Cruse and Jamie Foxx. The City alleged a history of violence at the premises justified revocation of El Rodeo’s permits, but Mr. Evans argued the violence was caused by gangs, not the El Rodeo and show that for ten years the City annually renewed El Rodeo’s permits with positive input from the Sherriff’s Department. |
